Terms of Use

These terms govern the use of the EVOLV mobile application. Creating an account or using the application constitutes unreserved acceptance of them.

1. Publisher

The EVOLV application is published by Ayoub Ouaid, 143 rue Général de Gaulle, 62221 Noyelles-sous-Lens, France. Contact: supportevolv@gmail.com.

2. Purpose of the service

EVOLV is a fitness and nutrition tracking application. It offers, in particular:

The publisher reserves the right to develop the application, and to add, modify or withdraw features.

3. Conditions of access

Use of the application is restricted to persons aged at least sixteen.

Creating an account requires a valid email address or the use of a Google or Apple account. The user is responsible for keeping credentials confidential and for operations carried out from the account. The user shall inform the publisher without delay of any unauthorised access.

The user undertakes to provide accurate information. The targets calculated by the application depend directly on the data declared.

4. Health notice

EVOLV is not a medical device and provides no medical advice.

Calorie targets derive from a statistical estimate based on the Mifflin-St Jeor equation. Training programs are suggestions of a general nature. The answers of the conversational coaches are generated automatically and may contain inaccuracies.

These elements are not a substitute for the advice of a doctor, a dietitian, a physiotherapist or a qualified trainer. Consulting a healthcare professional is recommended before undertaking a diet or a training program, in particular in the event of pregnancy, illness, injury or an eating disorder.

The user undertakes any physical activity at the user's sole responsibility, and shall immediately stop and seek medical advice in the event of pain, discomfort or abnormal shortness of breath.

5. Permitted use

The user shall not:

In the event of a serious breach, the publisher may suspend or close the account concerned, with prior notice where circumstances permit.

6. EVOLV Pro subscription

6.1 Free and paid versions

The application may be used free of charge. The free version gives access to the food journal, the barcode scanner, the programs, the pedometer and the progression system, together with limited use of the artificial intelligence features: one coach corresponding to the declared sport and a restricted number of meal analyses.

The EVOLV Pro subscription gives access to all specialised coaches, unlimited meal analysis, the personalised training program, advanced statistics and reserved content.

6.2 Prices and duration

Prices are inclusive of all taxes and may vary according to the country and the currency of the application store. The applicable price is presented by the App Store before any confirmation.

6.3 Trial period

A free trial period of seven days may be offered, limited to one trial per user. At the end of that period, the selected subscription is charged automatically, unless cancelled at least twenty-four hours before its end.

Where no subscription is taken out at the end of the trial, the reserved features are deactivated. The personalised training program generated during the trial is withdrawn; nutrition targets are retained.

6.4 Renewal and cancellation

The subscription renews automatically. It is renewed for an identical period at the rate then in force, unless cancelled at least twenty-four hours before the end of the current period.

Management and cancellation of the subscription take place in the settings of the user's App Store account, and not within the application. Cancellation takes effect at the end of the period already paid for, access to the reserved features being maintained until that date.

Deleting the application or the EVOLV account does not cancel the subscription, which must be cancelled separately.

6.5 Payment and refunds

Payment is charged by Apple to the user's App Store account upon confirmation of the purchase. The publisher has access to no banking data. Refund requests fall under Apple's terms and are addressed to Apple directly.

6.6 Right of withdrawal

The digital content included in the EVOLV Pro subscription is supplied immediately upon subscription. In accordance with Article L221-28 of the French Consumer Code, the user acknowledges that performance begins immediately and waives the fourteen-day right of withdrawal as from the opening of access to the reserved features. The terms of the application store remain applicable and may prove more favourable.

6.7 Price changes

The publisher may change its prices. Any change is subject to prior notice and applies only as from the following renewal, which the user remains free to decline by cancelling the subscription.

7. User content

Information entered by the user, and the user's photographs, remain the user's property. The publisher claims no rights over them and exploits them for no commercial purpose.

Use of an artificial intelligence feature constitutes authorisation to transmit the content concerned to the publisher's provider, for the sole period necessary to obtain the answer, under the conditions described in the privacy policy.

8. Intellectual property

The application, its brand, its visual identity, its texts, its exercise illustrations and its code are protected by intellectual property law. The publisher grants the user a personal, non-exclusive and non-transferable right of use, for the duration of the user's use of the application. Any other exploitation is subject to prior written authorisation.

Nutrition data obtained through the barcode scanner comes from the OpenFoodFacts database, made available under the Open Database License.

9. Availability of the service

The publisher employs reasonable means to ensure that the application functions, without guaranteeing uninterrupted availability. Maintenance operations, outages, the failure of a provider or technical constraints may temporarily interrupt all or part of the service, in particular the artificial intelligence features, which depend on an external provider.

10. Liability

The application is provided as is. To the extent permitted by law, the publisher shall not be liable in respect of:

No provision of these terms has the object or effect of excluding the publisher's liability in the event of gross negligence, wilful misconduct, or harm to life or physical integrity. The rights the user holds by law as a consumer, in particular the legal guarantee of conformity, remain fully applicable.

11. Deletion of the account

The user may delete the account at any time within the application: Profile, then Settings, then Personal information, then "Delete my account". Such deletion is permanent and entails erasure of the account from the publisher's servers as well as of the application data held on the device. The subscription must be cancelled separately.

12. Amendment of the terms

These terms may be amended. The date of the latest update appears at the head of the document. Any substantial amendment is notified within the application. Continued use of the application after such notice constitutes acceptance.

13. Governing law and disputes

These terms are governed by French law.

In the event of a difficulty, the user is invited to contact the publisher beforehand. Failing an amicable agreement, the user may have free recourse to a consumer mediator or refer the matter to the European Online Dispute Resolution platform. Failing amicable resolution, the French courts shall have jurisdiction, without prejudice to the protective rules applicable to consumers.

14. Provisions relating to Apple

Apple is not a party to these terms and is not responsible for the application or its content. Apple is under no obligation to furnish maintenance or support services in respect of the application. In the event that the application fails to conform to any applicable warranty, the user may notify Apple, which may refund the purchase price paid, if any; beyond that, Apple has no other obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against the user.
